3. SERVICES
3.1 Listing of Digital Assets: Via the Platform, Doge Labs offers Users the listing of Digital Assets:
3.1.1 In order to list a Digital Asset, the User has to fill out an application form as indicated on the Platform and determine the listing price in DOGE. This information is handed over to the User's Doge Labs Wallet or any other Wallet used by the User in accordance with section 9 which creates a partially signed Transaction ("PSDT"). The PSDT functions as a "blank check" containing the criteria of the User to which it would accept a sale of its Digital Asset. This PSDT is sent to the Platform and listed for potential buyers without any review by Doge Labs.
3.1.2 If a User wants to purchase a Digital Asset via the Marketplace, it has to connect its Wallet to the Platform. By clicking the "buy" button, the Transaction details for a listed Digital Asset in accordance with the PSDT are sent to the User's wallet. By signing the Transaction, the Transaction is executed, and the listing price as indicated is sent in DOGE to the wallet address of the seller. Doge Labs charges a service fee for such Transactions ("Service Fee"), which is automatically deducted from the amount of the listing price in DOGE and applicable Transaction Fees and transferred to a wallet held by Doge Labs. The respective Digital Asset is automatically transferred to the Wallet address of the buyer within the same Transaction, whereby such transfer means the publication of the Inscription on-chain within the Transaction data and, in particular, the tracking of the Transaction by the Indexers. Doge Labs is not involved in this Transaction, the Transaction happens peer-to-peer between seller and buyer only.
3.1.3 The execution of Transactions is not part of the Services. Doge Labs solely provides the Services, to enable the User to create PSDTs with Transaction details for the listing of Digital Assets on the Platform. Based on the PSDT, another User can execute Transactions via its Wallet for the purchase of such Digital Asset. The execution of Transactions is dependent on the User, PSDTs and other Transaction details, the Blockchain, Indexer protocols and other third parties. Therefore, Doge Labs is not responsible for the suitability of the PSDTs, Transactions, and/or the Services for the User's intended purpose and successful or error free execution of Transactions. In the event of a faulty Transaction executed by the User, Doge Labs cannot make any corrections or influence the Blockchain, Indexer protocols or return or transfer Digital Assets to the User. Doge Labs does not owe the existence, security, interoperability or maintenance of Digital Assets or the Services with a Blockchain and/or the Indexer Protocols.
3.1.4 The User is solely responsible for the execution of Transactions via its Wallet and/or applicable Transaction Fees. Transaction Fees are associated with the allocation of a Digital Asset on the Blockchain and cannot be influenced by Doge Labs. The amount of the Transaction Fees can only be determined immediately before the Transaction; it may vary from Transaction to Transaction.
3.1.5 Doge Labs itself does not offer to sell or purchase Digital Assets via the Platform. Doge Labs solely displays the listing of Digital Assets on the Platform.
3.1.6 Digital Assets listed are in an experimental state and there may not be a secondary market for Digital Assets. The listing of Digital Assets therefore does not provide a warranty or guarantee for a specific performance or valuation. Doge Labs makes no representations as to the value, functionality, compatibility, accessibility, continuity or security of the Digital Assets. The User lists or buys the Digital Assets at its own risk and liability.
3.2 Doge Labs Wallet: Doge Labs makes the Doge Labs Wallet available for download and installation via the Platform. The Doge Labs Wallet can be accessed by Users through a web browser. Doge Labs neither has access to nor controls the Doge Labs Wallet, users' digital assets or users' private keys in any other way. Doge Labs does not take any Digital Assets of the User into custody. The provision of and use of the Doge Labs Wallet are not part of the Services and/or these Terms.
3.3 Inscription Service: Our Inscription Service enables users to inscribe digital content, such as text or images, onto the Dogecoin Blockchain. It's important to understand the following key points, especially when inscribing text according to the drc-20 standard, before using this service:
3.3.1 Supply Limitation. Drc-20s minted that exceed the maximum supply of a specific drc-20 might be deemed invalid. We urge users to conduct thorough research (DYOR) before initiating any inscription requests.
3.3.2 Inscribing and Maximum Supply. In cases where a drc-20 is nearing its maximum mint limit, it is possible that the maximum supply may be reached before your transaction is processed by the Blockchain. Unfortunately, in such instances, we are unable to offer refunds.
3.3.3 Minting Duration. The process of minting can vary significantly in duration, potentially taking several hours or days to complete.
3.3.4 Irreversible Process. Once the minting process has begun, it cannot be halted or canceled.
3.3.5 No Refund Policy. Should the minting process encounter failures or errors, we cannot issue refunds.
3.3.6 Incorrect Address Transactions. No refunds will be provided in cases where DOGE is sent to an incorrect address.
3.3.7 Minting Charges. Each minting request incurs a fee, in addition to any gas fees associated with the transaction. This charge applies per minting call with a 'limit per mint'. An additional premium fee might apply.
3.3.8 Nature of Service. Our service is limited to the inscription of text & image files in a specified format. We do not sell or offer any digital assets, such as drc-20s, directly.
3.3.9 Dependence on Centralized Indexers. The recognition and validity of inscriptions, and in particular drc-20s, are subject to centralized indexers. We cannot ensure that these indexers will always acknowledge inscriptions made via our service as valid.
3.3.10 Variable DOGE Amounts in Minting. The amount of DOGE required for minting can fluctuate based on current network fees. As a result, the actual drc-20 amount you receive for the DOGE transferred may be slightly more or less than anticipated.
3.3.11 User Responsibility. Users are responsible for understanding the intricacies and risks involved in the minting process. By using our Inscription Service, the user acknowledges these terms and accept the associated risks and limitations.
3.4 Launchpad & Mintpad
3.4.1 Eligibility and Participation. Users must comply with local laws. Doge Labs reserves the right to deny access if requirements are not met.
3.4.2 Role of Doge Labs. Doge Labs does not sell Digital Assets via the Mint-& Launchpad. It only facilitates the minting of Digital Assets issued and controlled by third parties.
3.4.3 Acknowledgement of Risks. Users acknowledge that minting NFTs carries financial risk, including the possibility that the NFTs may be worth less than the mint price or may end up being worth nothing at all.
3.4.4 Minting Process and Availability. Due to high demand, users may not be able to mint NFTs in time. Doge Labs is not accountable for such situations, including service failures that prevent successful minting.
3.4.5 Fees and Payments. The launchpad may charge fees for listing and facilitation. Payments for NFTs must be made in the specified cryptocurrency or stablecoin. Doge Labs is not liable for payment errors.
3.4.6 User Conduct. Users must use the platform lawfully and respectfully. Prohibited activities include market manipulation and spreading false information. Accounts engaging in such conduct may be suspended or terminated.
3.4.7 Disclaimers and Limitation of Liability. The launchpad is provided "as is" without warranties. Doge Labs is not liable for indirect or consequential damages. Users agree to indemnify Doge Labs against claims arising from their platform use.
3.4.8 Amendments. Doge Labs may amend these terms. Continued use of the platform constitutes acceptance of the revised terms.
3.5 Roles and responsibilities: Doge Labs' role is limited to that of a technical service provider. Doge Labs solely provides the access to and use of Services and/or the Platform. Doge Labs does not assume any responsibility for the Blockchain, Indexers, the execution of Transactions or the transfer of Digital Assets.
Users use the Services, list and/or transfer Digital Assets at their own and sole responsibility. The User fully assumes and understands the responsibilities and risks as outlined in section 10.
3.6 Terms Applicable to the Software: Use of the Software is governed by these Terms. Doge Labs delivers the Software via download and will not provide you with any tangible copy of the Software. Subject to your compliance with the Terms, Doge Labs grants you a non-assignable, non-transferable, non-sublicensable, revocable, and non-exclusive license to use the Software on computers or mobile devices you own or control solely for your personal or internal business purposes. As the Software is locally installed, you are responsible for the security of the device on which it is installed, including keeping anti-virus software current and protecting the device against malware. You are responsible for securely maintaining any passwords or secret phrases that relate to your use of the Software. Storing a secret recovery phrase digitally or on cloud storage may increase the risk of compromise. Doge Labs is not responsible for theft of a secret recovery phrase, or any loss or damages – including loss of funds or lockout from accounts accessed via the Software – resulting from failure to keep the device safe and free of malware. Doge Labs may not be able to recover passwords or unlock account information stored on the Software if it is compromised by malware on your computer. It is your sole responsibility to take all reasonable precautions to secure and backup your copy of the Software and the information stored on it.
3.7 Updates: The Software and Services are evolving, and you may be required to accept or install updates to the Software or Services, or update third-party software (e.g., browsers or OS) to continue using the Software or Services or access their latest features, including security updates. Doge Labs may update the Software and Services at any time without providing notice. It is your responsibility to ensure that you are using the most recent version of the Software at all times.
